By downloading, installing, or using PathAIve ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
PathAIve ("Company", "we", "us", "our") reserves the right to modify these Terms at any time. Your continued use of the App after modifications constitutes acceptance of the updated Terms.
2. Use License
We grant you a limited, non-exclusive, non-transferable license to:
✓ Download and install the App on your personal devices
✓ Use the App for personal, non-commercial purposes
✓ Access and use the tour guide features
✓ Save photos to your device's gallery
You may NOT:
✗ Reverse engineer, decompile, or disassemble the App
✗ Reproduce, distribute, or sell the App
✗ Use the App for commercial purposes without permission
✗ Access the App through unauthorized means or APIs
✗ Violate any applicable laws or regulations
3. Intellectual Property Rights
All content in PathAIve, including but not limited to text, graphics, logos, images, audio, and software, is the property of PathAIve or its content suppliers and is protected by international copyright and intellectual property laws.
Your content:
Photos you take and save remain your property
Tour guide text is generated by AI and provided for personal use
You may not republish tour guide content without attribution
4. User Responsibilities
You agree to:
✓ Use the App in accordance with all applicable laws
✓ Respect the privacy of others when photographing
✓ Not use the App for harassment, abuse, or illegal purposes
✓ Not attempt to bypass security features
✓ Not use the App while driving or in situations requiring full attention
5. Disclaimers
"As-Is" Service
The App is provided "AS IS" without warranties of any kind, express or implied. We do not guarantee:
Accuracy of landmark identification
Uninterrupted or error-free operation
Compatibility with all devices or iOS/Android versions
Availability of third-party services (Firebase AI / Google AI, OpenAI, RevenueCat, Firebase)
Third-Party Content
PathAIve uses third-party services:
Firebase AI / Google AI models for image analysis and story generation
OpenAI for optional spoken follow-up transcription and voice generation
RevenueCat for subscription management
Firebase for authentication
Native device features (camera, gallery, location)
We are not responsible for their performance, accuracy, or compliance with any regulations.
6. Limitation of Liability
To the maximum extent permitted by law, PathAIve shall not be liable for:
✗ Direct, indirect, incidental, consequential, or punitive damages
✗ Loss of data, revenue, or business opportunities
✗ Damages arising from use or inability to use the App
✗ Damages from incorrect landmark identification
✗ Data loss or unauthorized access due to network issues
Total liability shall not exceed the amount you paid for the App (if any).
7. Subscriptions & In-App Purchases
Explorer Pass (Subscription)
Includes unlimited landmark scans
Auto-renews at the end of each billing period
Cancellable anytime in your device settings
Price may vary by region
Lifetime Purchase
One-time purchase
Unlimited access forever
No recurring charges
Refunds
Subscriptions: Handled by Apple/Google according to their policies
Refund requests must be made through Apple or Google using the store account used for purchase
We do not process refunds directly
8. Free Tier Limitations
PathAIve offers a free tier with:
✓ 5 free landmark scans
✓ Full camera and photo features
✓ After 5 scans, you must subscribe for unlimited access
This limitation helps us maintain server costs and AI processing resources.
9. Privacy & Data Protection
Our treatment of your data is governed by our Privacy Policy.
Key points:
✓ Your photos stay on your device only
✓ We don't store images on our servers
✓ PathAIve does not store camera images on its own servers
✓ Your preferences are stored locally on your device
10. Indemnification
You agree to indemnify and hold harmless PathAIve from:
Violations of these Terms
Violations of any applicable law
Infringement of third-party rights
Harmful or abusive use of the App
